End User Licence Agreement

All the information you need to know

1. Introduction

This Agreement governs your use of the Hier platform, including:

 

• The mobile application (the “App”)

• The website and dashboard.

• All related services (collectively, the “Platform”)

 

By using Hier, you agree to this Agreement.

2. Eligibility

You must be at least 16 years old to use the Platform.

 

If under 18, you confirm parental or guardian consent.

3. Definitions

•Candidate: An individual seeking employment.

•Business: A company or recruiter using Hier to hire.

•Content: Any data uploaded (profiles, CVs, messages, etc.)

4. License to Use the Platform (EULA)

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and Platform.

 

You may not:

 

• Reverse engineer or copy the Platform.

• Resell or distribute it.

• Use it unlawfully.

 

All rights remain owned by HIER APPLICATIONS LIMITED.

5. Accounts and Security

You must:

 

• Provide accurate information.

• Keep credentials secure.

• Be responsible for all activity under your account.

6. Acceptable Use

You must not:

 

• Create fake or misleading profiles.

• Harass or abuse other users.

• Misuse data or attempt to bypass safeguards.

7. Messaging and Conduct

We may:

 

• Monitor or investigate misuse.

• Restrict messaging.

• Suspend accounts engaging in harmful behaviour.

8. Job Applications and Hiring

Hier facilitates connections between Candidates and Businesses.

 

We:

 

• Do not guarantee employment outcomes.

• Are not responsible for hiring decisions.

9. AI Features

Hier may provide AI-assisted features (e.g. ranking, summaries).

 

These:

• Are informational only.

• May be inaccurate.

• Must not be solely relied upon.

10. Paid Plans and Billing

We offer subscription plans (e.g. Starter, Growth, Pro, Hier, Hier Pro).

 

• Billing is monthly unless stated otherwise.

• You may cancel anytime (effective end of billing period).

• No refunds, except where required by law.

11. Intellectual Property

All Platform rights belong to HIER APPLICATIONS LIMITED.

 

Users retain ownership of their Content but grant us a license to:

• Store.

• Process.

• Display.

PRIVACY & GDPR

12. Data We Collect

We may collect:

 

• Account data (name, email, phone)

• Profile data (CV, experience, content)

• Usage data (interactions, analytics)

• Device and technical data.

13. How We Use Data

We use data to:

• Provide and operate the Platform.

• Match Candidates and Businesses.

• Improve features and performance.

• Ensure safety and prevent misuse.

14. Legal Basis (UK GDPR)

We process data under:

 

• Contract (to provide services)

• Legitimate interests (platform improvement, fraud prevention)

• Consent (where required).

15. Data Sharing

We may share data:

 

• Between Candidates and Businesses (core function)

• With service providers (hosting, analytics, payments)

• Where required by law

 

We do not sell personal data.

16. Data Retention

We retain data only as long as necessary:

 

• Active accounts → ongoing

• Deleted accounts → reasonable retention period for legal/compliance.

17. User Rights (GDPR)

You have the right to:

 

• Access your data.

• Correct inaccurate data.

• Request deletion.

• Restrict or object to processing.

• Data portability.

RECRUITER / BUSINESS DATA PROCESSING

18. Business Responsibilities (Data Controller Obligations)

Businesses using Hier agree that:

 

They act as independent data controllers for Candidate data.They will:

 

• Comply with UK GDPR and applicable laws.

• Process Candidate data lawfully and fairly.

• Only use data for legitimate hiring purposes

 

Businesses must not:

• Export or reuse Candidate data outside the Platform without lawful basis.

• Store or process data in ways that breach privacy laws.

19. Platform Role (Processor vs Controller)

Hier acts as a data controller for platform operations.

 

•Hier acts as a data controller for platform operations.

•Hier may act as a data processor where processing data on behalf of Businesses.

TECHNICAL / APP STORE COMPLIANCE (EULA EXTENSIONS) 20. Apple App Store Terms

If you download the App via the Apple Inc. App Store:

 

• This license is between you and HIER APPLICATIONS LIMITED, not Apple

• Apple is not responsible for:

 - The App or its content.

 - Maintenance or support.

 - Claims, losses, or damages.

 

Apple may enforce this EULA as a third-party beneficiary.

21. Google Play Terms

If you download via the Google LLC Play Store:

• You agree to comply with Google Play’s terms

• Google is not responsible for:

 - The App.

 - Support or maintenance.

 - Any claims relating to the App.

RISK, LIABILITY & PLATFORM PROTECTION

22. Availability

We do not guarantee uninterrupted or error-free access.

23. Disclaimer

The Platform is provided “as is” without warranties.

24. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

 

• Hiring outcomes.

• User interactions.

• Loss of data or profits.

25. Suspension and Termination

We may:

 

• Suspend accounts.

• Remove content.

• Restrict access.

 

where misuse or violations occur.

26. Changes to This Agreement

We may update this Agreement.

 

Continued use = acceptance of updates.

27. Governing Law

This Agreement is governed by the laws of England and Wales.
